Terms and Conditions of Use

This Agreement (the “Agreement”) sets forth the terms and conditions governing your use of www.cadmotica.com (the “Site”). The Site is operated by Matteo Giordani under the brand named cadmotica (“CADMOTICA”), a CAD Design, and Technology Services firm based in Italy. By accessing and using the Site, you agree to comply with these Terms, including any modifications that may be made. Please review these Terms carefully, and keep a copy for your reference.

1. Acceptance of Terms

Your access to and use of the Site is conditional on your acceptance of this Agreement, as well as any updates or modifications we may make to these Terms. By using the Site, you agree to the practices outlined in our Privacy Policy and to receiving communications from us electronically as specified within this Agreement.

2. Description of Services

CADMOTICA provides a comprehensive suite of Engineering, Design, and Technology Services, including but not limited to 3D engineering design, CAD, structural design, MEPF/HVAC services, prototyping and related technical services. Through our Site, we offer access to information on these services and facilitate communication between CADMOTICA and its clients and partners.

All project deliverables are digital files unless otherwise agreed.

We do not offer physical prototyping, manufacturing, or material supply services.

3. Privacy and Consent for Communications

Your use of the Site is subject to our Privacy Policy, which is incorporated into this Agreement by reference. By using the Site, you consent to CADMOTICA collecting and using your personal information as outlined in the Privacy Policy.

4. User Responsabilities

By using our services, you agree to:

  • Provide accurate and truthful information during project requests.
  • Use our designs legally and ethically, complying with all applicable laws and regulations.
  • Ensure that any project data or specifications you provide do not infringe on third-party intellectual property rights.
  • Acknowledge that the accuracy of technical specifications in design projects is your responsibility if you provide incorrect or incomplete details.

5. Payments & Refunds

  • Invoices are issued electronically, and payments method includes PayPal and Bank Transfers.
  • Refunds are only issued under specific conditions, such as non-delivery of work or failure to meet agreed-upon specifications.
  • Once project work has begun, partial refunds may be considered on a case-by-case basis but are not guaranteed.
  • Payments must be made in full before project delivery unless otherwise agreed.
  • Advance payments may be required on a case-by-case basis.

You may cancel an Order before project commencement. Cancellations requested after payment has been made and the project is in progress may not qualify for a refund, as partial work may already be completed and expenses incurred.

6. Links to Third-Party Site and Services

The Site may contain links to other websites (“Linked Sites”) which are not controlled by CADMOTICA. We are not responsible for the content, updates, or practices of any Linked Site. Links are provided solely for your convenience, and inclusion of any link does not imply endorsement by CADMOTICA.

Certain services made available through the Site may be delivered by third-party sites and organizations. By using any products, services, or functionalities originating from the www.cadmotica.com domain, you consent to CADMOTICA sharing relevant information and data with third-party providers with whom we have a contractual relationship, as necessary to provide requested services.

7. Permissible Use of Intellectual Property

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use www.cadmotica.com strictly in accordance with these Terms. As a condition of your use of the Site, you agree that you will not use the Site for any purpose that is unlawful or prohibited by these Terms, or in any manner that could damage, disable, or impair the Site, or interfere with any other party’s use and enjoyment of the Site.

All content, including text, graphics, logos, images, and software on the Site, is the property of CADMOTICA or its suppliers and is protected by copyright and other laws. You agree not to modify, publish, transmit, reverse engineer, participate in the transfer or sale, create derivative works, or otherwise exploit any of the content on the Site. Your use of the Site does not entitle you to any unauthorized use of protected content.

  • Intellectual property rights over all project work are transferred to the client once full payment is received and the work is delivered.
  • After the transfer, CADMOTICA holds no liability for how the client uses the delivered work.
  • Until payment is completed, CADMOTICA retains full rights over the project work.
  • Clients may not claim authorship of CADMOTICA’s work prior to payment and delivery.
  • Any unauthorized use, reproduction, or distribution of the work before payment is strictly prohibited.

8. Limitation of Liability

All information, software, products, and services included in or available through the Site are provided “as is” without warranties of any kind. CADMOTICA disclaims liability for any direct, indirect, punitive, incidental, special, consequential damages or damages of any kind arising from the use or performance of the Site or related services.

  • We are not liable for indirect, incidental, or consequential damages arising from the use of our services.
  • While we strive for accuracy, CADMOTICA is not responsible for errors resulting from incorrect or incomplete client-provided information.
  • We do not guarantee that our designs will be free from all defects or that they will be suitable for specific manufacturing requirements unless explicitly agreed upon.

9. Warranties & Disclaimer

Our Services are provided "as is", without any warranties, express or implied. We do not guarantee the suitability of our CAD design for regulatory compliance, manufacturing processes, or any specific engineering applications. It is the Client's responsibility to validate and verify the design before using them in a commercial or engineering context.

10. Relationship of the Parties

You agree that no joint venture, partnership, employment, or agency relationship exists between you and CADMOTICA as a result of this Agreement or use of the Site. CADMOTICA performance of this Agreement is subject to existing laws, and nothing in this Agreement is in derogation of CADMOTICA right to comply with governmental, court, and law enforcement requests or requirements related to your use of the Site.

11. Severability

If any part of this Agreement is determined to be invalid or unenforceable pursuant to applicable law, the invalid or unenforceable provision will be superseded by a valid, enforceable provision that closely matches the intent of the original provision. The remainder of the Agreement shall continue in effect.

12. Termination

We reserve the right to terminate services if a client violates these terms, engages in fraudulent activity, or abuses our services in any manner. If termination occurs, outstanding payments must still be settled.

13. Modifications

We reserve the right to modify these Terms & Conditions at any time. Updated terms will be posted on this page and will take effect immediately upon posting.

14. Governing Law

These Terms & Conditions are governed by the laws of Italy. Any disputes arising from the use of our services will be handled in the courts of Rome.
